• To enter this competition, post your content to your Instagram profile, and tag @nikonkenya
• Your caption must include the camera model used, the challenge category for that specific post, and the hashtags #NikonKenyaDecathlonChallenge and #NikonKenya.
• All content submitted for the competition must be created with a Nikon camera.
• You can submit as many entries as you’d like, including in gallery posts, but should not make multiple submissions of the same image.
• By submitting works into this competition, you enter into the agreement detailed below.
Nikon Kenya Decathlon Challenge Photography Competition Agreement
This agreement is between Imaging Solutions Limited, a private limited company registered at [address], with company regsitration number [company registration number] (“Organiser”); and each competition entrant, defined as a social media network user who follows the Entry Guidelines outlined above on this webpage (“Entrant”).
• This photo competition is open to Kenyan citizens and residents only. By submitting works to this competition, Entrant certifies that they are eligible as a citizen or resident.
• By submitting works to this competition, Entrant certifies that he/she holds the copyright for the use of the submitted works. Entrant must hold all applicable rights to the final image, including any retouching or other image processing.
• Entrant is responsible for taking all steps necessary to protect the rights of persons depicted in the submitted works, including but not limited to obtaining their permission.
• Entrant will indemnify, defend, and hold harmless Organiser from all liability, claims, demands, causes of action, judgments, damages, fines and expenses (including reasonable attorneys’ and experts’ fees and costs) arising out of or as a result of submitted works created and/or published under the scope of the Agreement, except in the event that any claims, demands, causes of action, judgments, or expenses arose out of willful misconduct, gross negligence, or bad faith by Organiser.
• Entrant agrees to fully indemnify Organiser and accept all responsibility for any third-party complaints or objections concerning copyright or other intellectual property rights infringement or damages arising from the works submitted, as well as all claims for invasion of privacy, infringement of rights of publicity, defamation and any other personal and/or property rights by persons depicted in the works submitted.
• Except for any remedies that cannot be excluded or limited by law, Organiser and their affiliates will not be liable under this agreement to Entrant, any affiliate or other third person for any indirect, incidental, consequential, special, reliance, or punitive damages or lost or imputed profits, lost data or cost of procurement of substitute goods or services. Entrant may have rights that cannot be waived under consumer protection and other laws. Organiser does not seek to limit Entrant’s warranty or remedies to any extent not permitted by law.
• By submitting works for this competition, Entrant grants to Organiser a non-exclusive, limited license in perpetuity to use the submitted works on Organisers’ digital platforms, including but not limited to the Organisers’ websites and social media platforms. Use of the submitted works does not guarantee an award of any kind. Use of the submitted works in non-digital applications is not included within the scope of this Agreement. All uses of the submitted works by Organisers will include attribution to Entrant, in the form of Entrant’s name or social media network username.
• Subject to the rights and licenses granted herein, Entrant is and will remain the sole and exclusive owner of all right, title, and interest, throughout the world, to all submitted works and any copies of the submitted works. Entrant reserves all rights and licenses not expressly granted in this Agreement.
• Organiser reserves the right to disallow entries that depict brand logos or other intellectual property, whether on signs or posters or in other forms, or that in its judgment are harmful to the public order, violate standards of decency or are contrary to the goals of the competition.
• Submitted works that in the judgment of Organisers do not conform to the Entry Guidelines established on this webpage will be disqualified. Entrant will not be notified in this event.
• In the event that a winner is found to be disqualified after a prize is awarded, the award may be revoked and Entrant requested to return the prize.
